The Estonian Legal System
The Republic of Estonia, like most European countries, uses the civil law system, rather than the common law system used in the United States. This means that:
- Estonia’s system of civil law is built on the principle of Pandects, which divides all provisions of the civil law into five parts: general part of civil law, family law, property law, law of succession and law of obligations. The system of Pandects itself is derived from the law of Ancient Rome.
- Court decisions are based on these legal codes and not on judicial precedent;
- There is no jury system.
There are two district courts: Tallinn district court and Tartu district court. The Supreme Court is the highest court and hears appeals in cassation lodged against rulings from courts of second instance. There is no separate constitutional court in the Estonian court system. More information about Estonian legal system can be found here https://www.eesti.ee/en/legal-advice/the-legal-system/branches-of-law/
Selecting an Estonian Lawyer
Before hiring an attorney, consider contacting several attorneys, briefly describing the nature of the services you desire. Ask specific questions and expect the attorney to explain legal activities in language you can understand. Ask for a written schedule of fees generally charged for the services you require and inquire about the expected means of payment (e.g. cash, credit card), specifying currency and exchange rates where feasible. Do not turn over documents or funds to any attorney until you are certain that he or she fully understands your legal needs and is willing to handle your case.
The U.S. Embassy in Tallinn maintains the following list of attorneys to assist American citizens seeking legal representation in Estonia. The listed individuals and firms have informed the Embassy that they are qualified to practice law in Estonia and that they are sufficiently competent in the English language to provide services to English-speaking clients. The American Embassy in Tallinn assumes no responsibility for the professional ability or integrity of the individuals or firms listed.
